Terms of Service — The Graivier Center Online Store
Effective Date: September 1st, 2026
These Terms of Service ("Terms") govern your access to and use of the online store operated by The Graivier Center ("The Graivier Center," "we," "us," or "our") at thegraiviercenter.com (the "Site"), including any purchase of products through the Site. By accessing the Site or placing an order, you agree to be bound by these Terms. If you do not agree, do not use the Site.
1. Eligibility
You must be at least 18 years old, or the age of majority in your jurisdiction, to place an order through the Site. By placing an order, you represent that you meet this requirement and that all information you provide is accurate and current.
2. Products and Product Descriptions
We attempt to describe and display our products, including retail skincare products from the brands we carry, as accurately as possible. However:
- We do not warrant that product descriptions, images, pricing, or other content on the Site are accurate, complete, current, or error-free.
- Colors, textures, and packaging shown on the Site may vary slightly from the physical product due to manufacturer changes, photography, or display settings.
- We reserve the right to limit quantities, discontinue products, or correct pricing or description errors at any time, including after an order has been submitted.
3. Medical Disclaimer
The Graivier Center is a medical spa and plastic surgery practice. The products sold on this Site are professional-grade skincare products, and some are also used in connection with in-office treatments. However:
- Purchasing products through this Site does not create a doctor-patient relationship between you and The Graivier Center or any of its physicians, nurses, or staff.
- Nothing on this Site, including product descriptions, is intended as medical advice, a diagnosis, or a substitute for consultation with a qualified healthcare provider.
- Before using any product purchased through this Site, you should review the manufacturer's instructions and ingredient list, and consult a physician if you are pregnant, nursing, have a known allergy or skin condition, are using prescription topical medication, or are otherwise uncertain whether a product is appropriate for you.
- We recommend patch-testing any new topical product before full application.
- If you experience an adverse reaction to a product, discontinue use immediately and consult a physician. Serious reactions should be reported to your healthcare provider and, where applicable, the FDA.
4. Orders, Pricing, and Payment
- All orders are subject to acceptance by us. We reserve the right to refuse or cancel any order for any reason, including suspected fraud, pricing errors, or product unavailability, even after payment has been processed. If your order is canceled after payment, you will receive a full refund of amounts charged for the canceled portion.
- Prices are listed in U.S. dollars and are subject to change without notice. Applicable sales tax will be added at checkout based on your shipping address.
- Payment is due in full at the time of order. You represent that any payment method you use is your own or that you are authorized to use it.
5. Shipping
- Shipping timelines provided at checkout or by customer service are estimates only and are not guaranteed.
- Risk of loss and title for products purchased through the Site pass to you upon our delivery to the shipping carrier.
- As set out in our Return & Refund Policy, all shipping charges — including the cost of returning a product — are the responsibility of the buyer.
6. Returns and Refunds
All returns and refunds are governed by our Return & Refund Policy, which is incorporated into these Terms by reference. In summary: ALL SALES ARE FINAL. Please review the full policy before purchasing.
7. Gift Cards
Gift cards sold through the Site or in-office are not returnable or redeemable for cash except where required by law. Lost or stolen gift cards will not be replaced. Gift cards do not expire unless required otherwise by applicable law.
8. Intellectual Property
All content on the Site — including text, graphics, logos, images, and the Site's design — is owned by or licensed to The Graivier Center and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content on the Site without our prior written consent, except as necessary to place a personal order.
Product names, brand names, and logos of third-party manufacturers (e.g., Epicutis, Neocutis, Revision, Hydrinity, Plated, Jill Harper, EltaMD, PCA, VitaMedica, Xtresse, IS Clinical) remain the property of their respective owners and are used to identify authentic products we sell as an authorized retailer.
9. Prohibited Uses
You agree not to:
- Use the Site for any unlawful purpose or in violation of these Terms;
- Attempt to gain unauthorized access to the Site, other users' accounts, or our systems;
- Use any automated system (bots, scrapers, etc.) to access the Site without our prior written permission;
- Resell products purchased through the Site in a manner that misrepresents their source, authenticity, or condition;
- Submit false, fraudulent, or misleading information in connection with an order.
We reserve the right to refuse service, cancel orders, or terminate access to the Site for any user who violates these Terms.
10. Third-Party Links
The Site may contain links to third-party websites, including manufacturer sites, that are not owned or controlled by The Graivier Center. We are not responsible for the content, policies, or practices of any third-party site.
11. Disclaimer of Warranties
THE SITE AND ALL PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, EXCEPT AS EXPRESSLY STATED IN THESE TERMS OR AS REQUIRED BY APPLICABLE LAW. WE DO NOT WARRANT THAT ANY PRODUCT WILL PRODUCE ANY PARTICULAR COSMETIC OR THERAPEUTIC RESULT.
12. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, THE GRAIVIER CENTER, ITS OWNERS, PHYSICIANS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR ANY PRODUCT PURCHASED THROUGH IT, WHETHER BASED IN CONTRACT, TORT, OR OTHERWISE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR YOUR USE OF THE SITE SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE PRODUCT(S) GIVING RISE TO THE CLAIM.
Nothing in these Terms limits liability for personal injury caused by our negligence, fraud, or any other liability that cannot be excluded or limited under applicable law.
13. Indemnification
You agree to indemnify and hold harmless The Graivier Center and its owners, physicians, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Site, your violation of these Terms, or your misuse of any product purchased through the Site.
14. Governing Law
These Terms are governed by the laws of the State of Georgia, without regard to its conflict-of-laws principles.
15. Dispute Resolution — Binding Arbitration and Class Action Waiver
Please read this section carefully. It affects your legal rights.
Any dispute, claim, or controversy arising out of or relating to these Terms, your use of the Site, or any product purchased through the Site shall be resolved by binding arbitration, rather than in court, except that either party may bring an individual action in small claims court.
- The arbitration will be administered by a recognized arbitration organization (e.g., the American Arbitration Association) under its consumer arbitration rules, and will take place in, or be conducted by phone/video with a venue tied to, Fulton County or Forsyth County, Georgia, unless you and we agree otherwise.
- YOU AND THE GRAIVIER CENTER EACH WAIVE THE RIGHT TO A JURY TRIAL AND THE RIGHT TO PARTICIPATE IN A CLASS ACTION, CLASS ARBITRATION, OR REPRESENTATIVE ACTION. All claims must be brought in an individual capacity only.
- This arbitration agreement does not prevent either party from seeking injunctive or other equitable relief in court for infringement of intellectual property rights.
- If any part of this arbitration clause is found unenforceable, the remainder will still apply, except that the class action waiver may not be severed from the requirement to arbitrate if a court finds it unenforceable — in that case, the entire arbitration provision will be null and disputes will proceed in the courts identified below.
If arbitration is found not to apply for any reason, you agree that any legal action shall be brought exclusively in the state or federal courts located in Fulton County, Georgia, and you consent to personal jurisdiction there.
16. Changes to These Terms
We may update these Terms from time to time. The updated version will be posted on the Site with a revised effective date. Your continued use of the Site after changes are posted constitutes acceptance of the revised Terms.
17. Severability
If any provision of these Terms is found to be invalid or unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
18. Entire Agreement
These Terms, together with our Return & Refund Policy and Privacy Policy, constitute the entire agreement between you and The Graivier Center regarding use of the Site and supersede any prior agreements.
